Will Child Support be Reduced if I have more Children?
There are several reasons to go back to court to modify child support. One of reason that could justify a modification is having more children.
When you have another child, the child support guidelines allow for a reduction in the weekly income that is used to calculate your weekly support obligation. This reduction can be found in Section 3(C) of the Indiana Child Support Guidelines.
Simply having a child though is not enough to be able to modify and reduce your support, you would still need to show the court that the addition of the child in your child support calculation reduces your child support by 20% or the addition of the child renders the current support order unreasonable.
The best place to start is to go to the Indiana Child Support Calculator for Parents and calculate child support with your most recent information. From there you should determine if it makes sense to go back to court based on the most recent numbers. If you have questions or need advice, you should contact Vining Legal and we can go through the math with you in a free consultation.
