Custody changed after emergency action.
A child was exposed to dangerous substances while in the other parent's care. We moved quickly, documented the safety issue, and sought emergency relief. Custody was changed within eight days of filing.
DCS did not meet its burden.
We focused on investigative inconsistencies, credibility issues, and evidentiary gaps. The substantiation was not upheld and the agency record was cleared.
Level 4 felony dismissed.
Critical suppression issues were identified early, materially changing the posture of the prosecution. The charge was dismissed within approximately three months.
