How Do You Modify Child Support in Indiana?

In this video, I'm gonna talk about how you modify child support in Indiana. This is a common thing we deal with and it's normal for a person to review child support every couple of years through the family changes or job changes. My name is Nathan Vining. I'm a family law attorney in Indiana and I have experience litigating child support cases throughout the state. By the end of this video, you should know how and when you can modify child support in Indiana.

REVIEW CHILD SUPPORT CALCULATOR

So when looking at a child support case, the first thing to do is get familiar with a child support calculator. The state of Indiana has a child support calculator. It calculates the weekly support amount given your family's unique circumstances. I recommend that people get familiar with this calculator so they can periodically check to see if their support needs modified and understand what goes into the child support calculation. Once you are familiar with the calculator, there are two ways child support can be changed in Indiana and either party can petition the court to modify support.

20% CHANGE IN SUPPORT

The first is when 12 months have passed since the last support order, and the new support amount would defer by at least 20%.

SUBSTANTIAL CONTINUING CHANGE IN CIRCUMSTANCES

The second way is when there's been a substantial and continuing change in circumstances that make the current support order unreasonable. This includes things such as job loss, change in child care, or change in family makeup.

So now that you know a bit more about child support, I recommend periodically checking your calculations to see if the modification makes sense from time to time, and if you need help or have questions, you should call an attorney because sometimes the calculations could be more complex than they first appear on paper.
